LEGISLATION

Owners corporations are governed by a legislation and regulations including

Owners Corporations Act 2006

the Owners Corporations Act 2006 states that the owners corporation must, among other things, manage, administer, repair and maintain the common property.

Subdivision Act 1988

The Subdivision Act 1988 provides the legal framework for the subdivision and consolidation of land, the creation, variation and removal of easements, the management of common property and the creation of owners corporations.

Owners Corporations Regulations 2007 

The objective of the Regulations is to prescribe—

(a) the classes of prescribed owners corporations for the purposes of the Owners Corporations Act 2006;

(b) certain insurance requirements relating to owners corporations;

(c) when an existing owners corporation must establish an owners corporation register and information to be included on owners corporation certificates;

(d) fees, costs and charges payable under the Owners Corporations Act 2006;

(e) model rules for owners corporations;

(f) offences in respect of which an infringement notice may be issued;

(g) other matters authorised or required to be prescribed for the purposes of the Owners Corporations Act 2006.
 

Subdivision (Registrar's Requirements) Regulations 2011

he objectives of these Regulations are to prescribe—

        (a)     times for doing things required to be done by the Subdivision Act 1988 or these Regulations; and

        (b)     procedures for the registration of plans under that Act; and

        (c)     information to be included in any plans, statements and other documents prepared or given for the purposes of that Act; and

        (d)     other matters necessary to carry out that Act.

  

BI-LAWS

By-laws are made to ensure the dispute free, smooth running of a strata scheme and generally cover common areas and the behaviour of residents. All residents must adhere to the by-laws and any breaches may result in penalties and/or fines

By laws often cover items such as:

- Parking restrictions and use of allocated areas
- Keeping of pets
- Garbage disposal
- Use of facilities and common property
- Ownership and Maintenance responsibilities of some common property
- Behaviour of residents - noise, hanging of washing, offensive behaviour, etc
- Security and Safety measures
- Architectural and landscaping guidelines
- Installation and use of Floor coverings
- Installation and use of Air conditioners, pergolas, TV & satellite access
